1. COOKIES AND THEIR CLASSIFICATION

1.1. Cookies

What are cookies?

Cookies are small text files sent by the visited website to the user's device (usually to the browser), where they are stored in order to recognize that device on subsequent visits. Indeed, on each subsequent visit, cookies are resent from the user's device to the site.

Each cookie generally contains: the name of the server from which the cookie was sent; the expiration date and a value, usually a random unique number generated by the computer. The website server that transfers the cookie uses this number to recognize you when you return to visit a site or navigate from one page to another.

Cookies can be installed not only by the manager of the site visited by the user (first-party cookies), but also by a different site that installs cookies through the first site (third-party cookies) and is able to recognize them. This happens because the visited site may contain elements (images, maps, sounds, links to web pages of other domains, etc.) that reside on servers different from that of the visited site.

Based on their purpose, cookies are distinguished into technical cookies and statistical/profiling cookies.

Technical cookies are those used solely for the purpose of "transmitting a communication over an electronic communications network, or to the extent strictly necessary for the provider of an information society service explicitly requested by the subscriber or user to provide such service" (cf. art. 122, paragraph 1, of the Privacy Code). In particular, such cookies are usually used to:

  • Allow efficient navigation between pages

  • Store user preferences (language, country, etc.)

  • Perform computer authentication

  • Manage shopping carts

  • Enable online purchases

Some of these cookies (called essential or strictly necessary) enable functions without which it would not be possible to perform certain operations. Pursuant to the aforementioned art. 122, paragraph 1, of the Privacy Code, the use of technical cookies does not require user consent.

Analytics cookies are assimilated to technical cookies if used directly by the site manager to collect aggregated information on the number of users and how they visit the site. These cookies allow site owners and/or managers to understand how users interact with site content for optimization purposes.

Profiling cookies, on the other hand, are used to track user navigation, analyze their behavior for marketing purposes, and create profiles of their tastes, habits, choices, etc., in order to transmit targeted advertising messages in relation to the user's interests and in line with the preferences manifested during online browsing. Such cookies can only be installed on the user's terminal if the user has expressed consent with the simplified methods indicated in the Decree.

Based on their duration, cookies are distinguished into:

  • Persistent cookies: remain stored on the user's device until their expiration, unless removed by the user

  • Session cookies: are not persistently stored on the user's device and disappear when the browser is closed
